General Terms and Conditions for Immigration and Career Consulting Services
1. Scope
M/S. German Opportunity Card provides paid immigration and career consulting services to individuals and organizations, as well as free information through the website https://germanopportunitycard.com, and social media profiles. These General Terms and Conditions govern all business dealings related to these services (contracts, consultations, events, digital products, etc.) with individuals and organizations (hereinafter “Clients”), unless expressly excluded in writing. For organizational Clients, any conflicting or supplementary terms and conditions are explicitly rejected unless M/S. German Opportunity Card provides written consent to their inclusion.
M/S. German Opportunity Card’s services do not constitute or replace legal advice. Information provided verbally or in writing describes employment and immigration possibilities in Germany, including qualification recognition, visa processes, and other administrative procedures.
Changes to these terms will be communicated to the Client via email. Clients must object to changes within four weeks of notification; otherwise, the changes are deemed accepted.
2. Consulting Assignment
The scope of the consulting contract is defined by the individual offer or the booked service (e.g., consultation, digital product). M/S. German Opportunity Card may use expert partners to fulfill the consulting assignment, in whole or in part.
3. Offers and Contracts
M/S. German Opportunity Card’s consulting services are non-binding and subject to change. A contract is formed only upon M/S. German Opportunity Card’s written offer being expressly accepted by the Client (via email), or when the Client schedules and/or pays for a service. Additions or side agreements require the same process.
4. Client Obligations
The Client must provide all necessary information and documents for the consulting assignment promptly and inform M/S. German Opportunity Card of all relevant processes and circumstances.
Consultation fees are non-refundable once paid, as preparation begins immediately. The sole exception is if M/S. German Opportunity Card determines the Client requires legal advice before the scheduled consultation. In this case, the consultation will be canceled, and a full refund issued.
Consultations can be rescheduled free of charge up to 12 hours before the appointment via the link in the invitation or by contacting M/S. German Opportunity Card.
M/S. German Opportunity Card will make every effort to be on time and expects the same from Clients. A 20-minute grace period is provided. Clients who do not join within this time will be considered a no-show, and the session will be terminated without a refund.
5. Payment
a) Consulting fees are based on the rates specified in the individual offer or on the website. b) All invoices are payable before the consulting service is provided.
6. Liability
All documents and consultations are provided to the best of M/S. German Opportunity Card’s knowledge and belief, with utmost care. However, no liability is assumed for the provided consultation, suggested immigration and career strategies, or specific application content. This responsibility rests solely with the Client. M/S. German Opportunity Card cannot guarantee visa approval or job placement.
M/S. German Opportunity Card adheres to generally accepted professional standards. Liability for damages is limited to cases of proven intent or gross negligence.
7. Confidentiality
M/S. German Opportunity Card and appointed partners are obligated to maintain confidentiality regarding all information acquired during their work with the Client. M/S. German Opportunity Card ensures data secrecy in accordance with applicable data protection laws.
8. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Bangladesh, excluding its conflict of law rules.
The Client and M/S. German Opportunity Card will attempt to resolve any disputes arising from these Terms through negotiation. If an agreement cannot be reached, the courts of Dhaka, Bangladesh, shall have exclusive jurisdiction. The Client irrevocably submits to this jurisdiction and waives any objections based on inconvenient forum or otherwise.
Failure by M/S. German Opportunity Card to enforce any right or provision does not constitute a waiver of that right.
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in effect.
